RESPONDENT'S MOTION FOR ENLARGEMENT OF TIME TO RESPOND TO ORDER

REQUIRING ANSWER

COMES NOW the Respondent, QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC., by and through its undersigned attorney, and hereby files their Motion for Enlargement of Time to file an Answer to the Order entered on September 10, 2008, and in furtherance hereof, states as follows:

            1.        The Respondent, QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC.,

seeks an additional period of time of ten (10) days from September 30, 2008 in which to

file their Answer to the Order entered on September 10, 2008.

           2.        The undersigned was just recently retained by QUAIL HOLLOW

CONDOMINIUM ASSOCIATION, INC.

           3.        The Respondent and the undersigned received only Pages 1-4 of the Notice

of Communications, Order Striking Certain Filings and Order Requiring Answer by facsimile on September 30, 2008 from former counsel for QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC. The undersigned was advised that the document, in its entirety, is over

 300 pages and former counsel for QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC. advised this morning they would mail the complete document to the undersigned.

           4.         Prior to September 30, 2008, neither QUAIL HOLLOW CONDOMINIUM

ASSOCIATION, INC. nor the undersigned received any documentation concerning this matter, as all documents were furnished directly to QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC.'s former counsel and Registered Agent, The Coates Law Firm.

           5.        QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC.'s former counsel

and Registered Agent previously failed and refused to timely provide the undersigned or QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC. with any documents in its possession concerning this matter.

           6.         QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC. should not be

punished or sanctioned due to the failure of its former counsel and registered agent to either act or provide the necessary information to QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC. so that action could be taken.

            7.         Due to the undersigned's schedule and a delay in obtaining the information

necessary to respond to the Order entered on September 10, 2008, the Respondent is unable to respond at this time.

            8.        This Motion for Enlargement of Time is not being interposed for the purpose

of delay or to protract this proceeding, and the parties would be not be prejudiced by the granting of this Motion at this time.

WHEREFORE, Respondent, QUAIL HOLLOW CONDOMINIUM ASSOCIATION, INC., respectfully requests that its Motion for Enlargement of Time in which to file its Answer to the Order is granted.
