FIRST SERVICE RESIDENTIAL, INC.  –

 COMPLAINTS, COMPLAINTS …

An Opinion By Jan Bergemann

It seems like complaints are piling up against one of the biggest association management companies in the nation: First Service Residential, Inc., formerly known as Continental.

They may have changed their name, but obviously not the way they are operating.

I get lots of complaints from owners and board members alike, who are complaining about the methods used by this management firm.

But now even the official government departments seem to have taken notice. An Administrative Complaint was filed on December 2020 – DEPARTMENT OF BUSINESS AND PROFESSIONAL REGULATION v. FIRSTSERVICERESIDENTIAL FLORIDA, INC – alleging five counts of violations of Florida statutes (FS 468.431 – 438) and the Florida Administrative Code (FAC), including unlicensed activity and “improper financial withdrawals and deposits". For more details please read the attached “ADMINISTRATIVE COMPLAINT”.

And other states have taken action against FirstService Residential as well. The COMMON INTEREST COMMUNITY BOARD of The COMMONWEALTH OF VIRGINIA issued in 2019 a CONSENT ORDER against FirstService Residential DC Metro LLC., based on financial irregularities as noted in the CONSENT ORDER.

Let’s face: Laws and regulations should be obeyed by and licensed professionals should be aware that violations are dealt with accordingly, not just weith a slap on the wrist.

Hopefully this is just the beginning of our government agencies doing their job and a going after licensed professionals and companies who violate laws.

Any good law and regulation is only effective if properly enforced. These laws and regulations were created in order to protect citizens and property-owners from licensees who ignore these laws and regulations.
