OPEN LETTER TO DBPR SECRETARY JONATHAN ZACHEM

Dear Secretary Jonathan Zachem,

 

With all due respect: Your department is totally failing Florida’s citizens. Especially the leadership of the Division of Florida Condominiums, Timeshares and Mobile Homes is totally ignoring the cries for help by Florida’s condo owners who are paying their salaries. THIS IS UNACCEPTABLE!

 

Condo owners and homeowners all over Florida are outraged – and this year’s Grand Jury report published by the Miami-Dade State Attorney’s office filed on February 6, 2017 makes it very clear that the Division and especially its leadership are inapt and are doing more harm than good to Florida’s condo owners.

 

FLORIDA’S CONDO OWNERS ARE OUTRAGED!

 

Over the last 10 years we have had DBPR Secretaries come and go – with an average life-span of about 18 months. Then, with the complaints about the ineffectiveness and dismal performance of the DBPR piling up, the governor – all governors so far showed the same modus operandi -- replaced the secretary and the same circle started again.

 

We are fully aware that being DBPR Secretary is an appointed position – meaning we owners can’t vote you – or your incompetent employees -- out of office. But, we all know that the person who appointed you to your momentary position is Governor Rick Scott who is running for state-wide political office next year – meaning voters could blame him for the total failure of the DBPR. Is that what you have in mind by ignoring the pleas of millions of homeowners and condo owners – a wide majority of them being registered voters?

 

It is about time that you appoint people to positions within the Division of Florida Condominiums, Timeshares and Mobile Homes and its Arbitration Section who are willing to do their job and enforce the laws created by Florida’s elected officials.

 

The same do-nothing people are in leadership positions for many years, doing lots of damage to Florida and the reputation of the former “Sunshine State”. There is little sunshine left for Florida’s condo owners. Florida has a reputation as a state not enforcing its laws.

 

Division staff writes misleading and even factually wrong letters to Florida’s citizens in order to protect their own shortcomings. Staff members have even serious conflicts of interests. You could call it as well: They flat out lie! There have been many cases where citizens accused the DBPR of not regulating businesses and professions, but actually protecting them against legitimate complaints filed against them.

 

I am now since 17 years collecting documentation about DBPR problems, especially about the Division of Florida Condominiums, Timeshares, and Mobile Homes and community association manger (CAM) regulation. The content of these documents is devastating. Documents don’t lie – unlike employees – and are proof that the Division is dysfunctional.

 

ARE YOU GOING TO MAKE THE MUCH NEEDED CHANGES AND APPOINT PEOPLE TO THE POSITIONS NEEDED TO DO THE JOB? WILL THE DIVISION'S PERFORMANCE IMPROVE UNDER YOUR LEADERSHIP?

 

FLORIDA’S VOTERS DEFINITELY HOPE SO!
