Highlights of condo, homeowner bills being debated
Homeowner Associations

Allow contracts for purchase to be canceled within three days if certain information isn't provided by seller. H611; S1402.

Require associations to let everyone vote in association elections, even if they haven't paid their assessments. S408.

Extend the 30-year period that homeowner associations can exist. H589; S1438.

Allow penny-ante games to be played in common areas of condominiums and homeowner associations. S2474; H1155.

Condominium Associations

Establish the office of ombudsman to resolve disputes between owners and associations, fine board members and remove board members; prevent associations from changing rules allowing renting and having pets; protect owners by giving them 30 days' notice that a lien will be filed; require that money paid to an association after an attorney writes an indebtedness letter be applied first to the debt and then to the attorney's fees; create a condo owner's bill of rights; require a majority of owners to approve most special assessments; require training for new board members; create a state advisory council on condominiums. Let associations exempt themselves from having to install handrails and guardrails in buildings considered "housing for older persons." S1728; H1017.

Require that associations notify all owners before filing a lawsuit against an owner; protect developers from being sued for oral representations of sales people; prohibit suits for misleading oral representations made by a seller, allowing suits only if written information is misleading. S298; H1507.

Let associations exempt themselves from having to install fire sprinklers in common areas. S1938; H747.

Set new time limit for Bureau of Condominiums to act on an owner's complaint from 90 days to 60 days. S666.

Require non-developer sellers of condos to provide disclosure to buyers. S1990.

Require sellers of condos who aren't developers to provide buyers with a question-and-answer sheet. H1663; S2498.

Protect associations from liability for information they provide purchasers; prohibit insurance companies from making associations buy medical malpractice insurance as a condition of obtaining other insurance if they have automatic defibrillators; require notice to owners before certain assessments or rule changes can be made. S1184; H411.
