SB 788: Homeowners’ Associations (Senator Linda Stewart)
We should support this bill, but we should add a measure for
non-compliance.
The bill amends the current homeowner association powers and duties
under s. 720.303, F.S., by addition of a new subsection (13).
Subsection (13) requires (i) distribution and timeframe of digital
copies of the association’s rules and covenants to current members
by October 1, 2023 and any new member thereafter, (ii) allows the
association to adopt rules establishing standards for the manner of
distribution and timeframe of providing copies of updated rules or
covenants, and (iii) becomes effective as of July 1, 2023.
While this bill is a start using digital distribution, it still
provides no enforcement measures against boards and/or LCAMs for
non-compliance.
