(12). OFFICIAL RECORDS The bill amends accounting records to include the verbiage “all bank statements and ledgers.” The bill amends the verbiage “photocopy” ” to substitute the term “copy.”
Condominiums with more than 150 units (not timeshare). must post documents on the association's website or make available for download through an application on a mobile device within 30 days after the association receives or creates an official record specified in subparagraph 2. Subparagraph 12(a) adds a new paragraph 20. “All signed affidavits as required by s. 718. F.S.” (This includes delivery requirement compliance affidavits executed by an officer or director of an association on member requests for financial reports that are furnished by mail, hand delivered, or electronically sent). The bill provides that consent for cash receipts and expenditures to be prepared by the association must be voted by the majority vote of all the voting interests of the association. Previously, it was the majority vote of voting interests present at a properly called meeting. The bill amends subparagraphs 12(c)2 to provide a safe harbor provision for a CAM and members of the board of an association on violations of subparagraph 1. which constitutes a misdemeanor of the second degree, deletes the term “repeatedly” and substitutes the term “intentionally.” |
