Section 9. Paragraphs (d) and (e) of subsection (5) of section 718.113, Florida Statutes, are amended to read:

The bill clarifies the duties and the responsibility of hurricane protection and its costs:

• Paragraph (d), adds the term “[u]nless otherwise provided in the declaration as originally recorded, or as amended, a unit owner is not responsible for necessary hurricane protection costs (including removal or reinstallation of exterior windows, doors, etc.). In addition, the bill provides that the board shall determine if the removal or reinstallation of hurricane protection must be completed by the unit owner or the association if the declaration as originally recorded, or as amended, does not specify who is responsible for such costs.”

• Paragraph (e) is deleted.
