Dear Florida Homeowner and Condo Owners;

Political signs are the talk of the town. All kinds of attorneys are chiming in -- and most of them will tell you that the US Constitution isn't valid within community associations. As Shu Bartholomew always said: Community associations should be mandated to post a sign at the entrance: "YOU ARE LEAVING THE AMERICAN ZONE!" It's time for our esteemed legislators in Tallahassee to make some changes to the statutes. Many other states have created laws allowing owners in community associations to post campaign signs before elections -- with certain restrictions like time, size etc.

Florida's ban on evictions has expired. Will that mean that associations will now have to deal with lots of foreclosures -- or will cooler heads prevail and allow owners in arrears to pay on agreed-upon payment plans? Foreclosures are nasty -- and often very expensive for both sides. Please consider that families got into financial trouble caused by the virus, not by the irresponsibility of the owners. I just hope that all parties involved will act in a reasonable manner.

Embezzlement -- embezzlement! It seems that no week is going by without some association board member or manager is being arrested for theft or embezzlement. And when you read the stories behind the arrest you'll find out that this embezzlement or theft is going on since years. That really makes me wonder: Are the other board members fast asleep at the wheel -- or do they just don't care? Board membembers have a fiduciary duty to protect their neighbors -- and serve fr the benefit of all members. Serving on the board means serving the community, and not just to lift the "social standing".

This week we are blogging about term-limits for condominium board members. Since the Florida legislature added three years ago a provision to FS 718 calling for an 8-year term-limit for board members, a serious fight is raging over the interpretation of the law. Was it worded so that it applies retroactively, or did the term start at the moment when the bill was enacted. Please read my blog posted yesterday: "TERM-LIMITS FOR CONDO BOARD MEMBERS?"

Police: HOA president stole thousands of dollars from community to buy stamps, lawn equipment
Over the course of three years, a former homeowners association president stole $20,000 from the community he served and used the money to expand his stamp collection and buy lawn equipment, according to the Titusville Police Department. Brett Rowe, 51, was named HOA president of Shady Oaks Pine in 2017 and records show at that time, there was about $21,000 in the HOA’s Bank of America account.

Florida’s ban on evictions has expired. What now for tenants who are months behind on rent?
Gov. Ron DeSantis has finally allowed his moratorium on residential evictions to expire, six months after it took effect on April 2. In a statement released late Wednesday afternoon, DeSantis noted that the U.S. Centers for Disease Control and Prevention recently imposed a nationwide order that forbids eviction of tenants who submit a declaration to their landlords and attest that the COVID-19 crisis has left them unable to pay their rent.

Fort Myers couple looking for answers after HOA removes their chimney
A Fort Myers couple is looking for answers after they say their homeowners association removed part of their home without their approval. The couple is now desperately trying to figure out what they can do. For John Plowy and his wife, Susan, retiring in their Timberwood Village II condo was something they had been looking forward to for the past 15-years. "[It's] what we waited for and worked hard our whole lives for — to be at this stage of our lives, we just newly retired,” said Susan Plowy.

No Changes to HOA, Condo Political Sign Landscape as Election Season Gears Up

http://www.ccfj.net/HOAFLPolSigns.html

Political polarization in 2020 has reached a COVID-fevered pitch, ignited by shadowy entities of all kinds fueling a whole lot of anger. As if things weren’t volatile enough, it’s now election season in Florida, which boasts more community associations than any other state in America. When we really believe in something, many of us feel a gut-level need to make a difference. Make a statement. Contribute.

Developer presents revised plans for North Naples condo community
A developer wants to build more than a hundred condo units that some people say will block their view of paradise and bring more traffic to North Naples. One Naples is planned for the intersection of Gulf Shore Drive and Vanderbilt Beach Road. STOCK Development said it has had nearly 50 meetings with community members to address the height issue, unit numbers and traffic concerns. They’ve lowered the height to 16 stories and current plans are for 172 units.
