Dear Florida Homeowner and Condo Owners;

 

It's amazing how easy it it is to create a juicy -- and in the end very expensive -- lawsuit. All the board has to do is misinterpreting the word MAINTENANCE. According to Google and Webster the meaning of the word maintenance is: "the process of maintaining or preserving someone or something, or the state of being maintained." In case of a tree it means trimming branches or removing dangerous roots. Nowhere in the definition of the word "MAINTENANCE" can anybody find the words removal and/or replacing anything with anything new. The board members of a HOA in Palm Beach County -- obviously supported by the association attorney -- seem to have some serious difficulties in dealing with the word "Maintenance". The result: A lawsuit that will cost the owners of this HOA lots of money. Isn't it a shame to see how some board members are wasting their neighbors' money?

Tivoli Lakes saga: Residents file lawsuit to block removal of 272 mahogany trees
The 272 mahogany street trees at Tivoli Lakes will be around for a while longer — at least until a judge decides whether they can be taken down. TREE (Tivoli Residents Environmental Enthusiasts) recently filed a lawsuit seeking a temporary injunction to block their removal, raising the contentious dispute at the west Boynton Beach retirement community to a higher level. The residents group went so far as to individually sue the members of the HOA board.
  
Developers looking to put 861 single- and multi-family homes on DeLand former golf course
For about 50 years the site at 800 E. Euclid Ave. in DeLand was a hilly, par-72 golf course with narrow fairways. Sandhill Golf Course closed in 2017, and the former fairways have become overgrown while the 10,000-square-foot clubhouse remains boarded up. But this month the DeLand City Commission gave Orlando-based Elevation Development the final nod of approval to designate the former golf course as a brownfield site.

SEVEN BRIDGES DELRAY: Federal Judge Permits Tannenholz To Avoid Deposition, For Now

The federal judge overseeing the soap-opera-like lawsuit that pits Seven Bridges Homeowner against Seven Bridges Homeowner against the Seven Bridges HOA has agreed to temporarily let one of the accused “mean girls” avoid a deposition. U.S. District Judge Donald Middlebanks just ruled that Rachel Tannenholz can avoid a deposition while he decides whether she should remain a party to the suit. Tannenholz is accused of harassing homeowner Deborah LaGrasso online and in person, allegedly telling her that she shouldn’t live in Seven Bridges because she’s not Jewish.

    

As property insurance costs skyrocket, lawmakers will consider these ideas to keep coverage affordable

As Florida homeowners recover from shocking cost increases for their next year of insurance coverage, pressure is mounting on state lawmakers to step in and stem the bleeding. Property owners have been waking up to premium hikes as high as 30% to 40% for their upcoming policy terms. Insurance insiders hope their anger will force the Florida Legislature to adopt reforms aimed at quelling runaway litigation costs during the 2021 legislative session that begins March 1.

    
Aventura office condo owners allege construction defects at Beacon Tower
The association for a 12-story office condo tower near Aventura accuses developer H&M Development of shoddy construction. The Beacon Tower of Aventura Commercial Condominium Association is suing the developer of the building at 20200 West Dixie Highway in Miami-Dade Circuit Court, according to documents filed last week. The association includes president Dr. Joshua Lampert, a plastic surgeon who runs his business in the tower.
 

Developer withdraws request for covered arenas in Wellington equestrian neighborhood

A proposal for covered arenas in a Wellington equestrian community has been withdrawn. The Village Council tentatively approved the application to allow roofs over equestrian rings in Winding Trails in July, although officials asked planners and the developers, Tricia Holloway and Jim Ward of W&W Equestrian Club LLC, to do more public outreach and bring renderings for the second and final review.

 

Suspected gunman arrested in deadly shooting at Altamonte Springs condo complex

A 26-year-old man was arrested Tuesday in the fatal shooting of a 28-year-old man at an Altamonte Springs condominium complex, police said. Police said they arrested Heriberto Cruz-Vargas in connection with the shooting at the Destiny Springs Condominiums on North Wymore Road. Officers said they found Zachary Duarte lying on the floor of the condominium with a gunshot wound to his chest at about 10 p.m.
