Dear Florida
Homeowner and Condo Owners;
Election fraud seems to be the latest national
sport in our country. Not only in our general
election, but as well in condo and HOA
elections. Obviously some board members and
attorneys want to make everybody believe that
the restrictions due to the Chinese Virus
invalidate our laws. Believe me: That is not the
case! To me it's just amazing how blatantly
attorneys and board members are willing to claim
that the statutes are no longer valid and they
can do whatever they want! How would you feel if
you get a notice saying: "Due to the Virus
restrictions we can't hold our annual meeting
this year -- meaning the annual elections are
cancelled as well. We will hold the annual
meeting next year in December according to our
bylaws. The sitting board members will serve
until December of next year!" If it would happen
once or twice I may consider it some nonsense
allowed by a dictatorial board supported by a
"willing" attorney, but I have heard this story
more often than I can count. To me it looks like
people think that Law and Order are no longer
valid until the Pandemic is over. Are we turning
into a lawless country?
Oh, by the way -- just in case you haven't heard
it all: Remember the fight about picture ID's
required for elections? Remember, the Democrats
claiming that requiring picture-ID's is racist?
Personally I think it's nonsense -- and if
required we wouldn't see election results being
decided by courts. But now a condo association
in Palm Beach in a county that heavily voted for
Democrats requires picture-ID's for their annual
election -- the dictatorial board trying to stay
in power by making elections more complicated
for the owners. In my opinion condo election
provisions are anyway pretty safe since all
documents have to be reserved for one year --
unlike in our general election where election
officials decided to destroy ballot-envelopes
before anybody could look at them.
I get the feeling that attorney Robert Rubin
from the Becker Law Firm makes a great living of
lawsuits involving the Boca View Condominium
Association, Inc. in Boca Raton. The latest
addition to a long list of costly lawsuits: A
Federal Discrimination lawsuit over the
rejection of a rental application of a nurse by
the president. Owners who dared to criticize the
board president or the CAM found themselves
listed as defendants of some often weird
lawsuit, much to the pleasure of attorney Robert
Rubin. The attempts of owners to find out the
cost of these lawsuits were plainly ignored. And
the Division of Condominiums is obviously
unwilling to take any action in regards to these
violations of FS 718, despite the fact that FS
718.501 clearly gives them jurisdiction over
record requests. The statutes clearly says that
the Division "shall issue a subpoena requiring
production of the requested records..." if an
official record request by an owner is ignored
by the association.
This week we are blogging about RESERVES
-- and how to deal with the provisions
in the statutes that deal with
regulating budgets and reserves. Budget
meetings and reserve funding causes each
year lots of serious arguments --
arguments even ending up in arbitration

STILL NO RESPONSE
FROM BOCA CONDO BANNING NURSE DUE TO COVID FEARS
The latest protest came and went
but there is still no response from
Pointe Management or Diane Kuka, the
management company and the board
president for Boca View
Condominiums. As we reported, condo
owner Greta Tremmel wants to welcome
an ICU nurse into her unit under a
lease. But the condo board at Boca
View has apparently refused, with
the association’s president telling
Tremmel that nurses can’t live in
the building due to their potential
exposure to COVID-19.

early results on Thursday showed Latinas for
Trump co-founder Ileana Garcia leading
Democratic incumbent José Javier Rodríguez in
the race for Senate District 37 by a mere 34
votes. In a video posted shortly after the
recount was done, Rodríguez conceded and called
for an investigation into the race, raising
concerns about the influence of a third-party
candidate backed by dark money who received more
than 6,300 votes in an election decided by a few
dozen out of more than 215,000. |
Why Most Florida
Condominiums Don’t Qualify for FHA Financing
Let’s start with some background on
FHA-insured mortgage financing. The Federal
Housing Administration (FHA) is an agency of the
US Department of Housing and Urban Development
(HUD), a Cabinet-level department of the Federal
government. In order to help make mortgage
funding available to a broader rangeof buyers,
the FHA insures independent lenders against
buyer/borrower default. The FHA does not make
mortgage loans, it insures them.
Buyers/borrowers pay mortgage insurance premiums
to the FHA; the lenderreceives the insurance
payout from the FHA if the buyer/borrower

Worker dies in fall at Jacksonville Beach condo
complex

A man doing work
at a high-rise condominium complex at the beaches
died Wednesday morning when he fell about 100 feet
in what appears to have been an accident. The man
was identified as Paul Knight. According to the
incident report, the 49-year-old construction worker
fell as he tried to jump to an elevator while
working on a 10th floor balcony on the north side of
the building, which did not have a rail. |
