Accuses Continental Group of Breaking the Law
By
Firing, Threatening, and Harassing Employees
Union
says Continental has illegally harassed workers seeking to unionize

Service Employees International Union (SEIU) Local 11 has filed Unfair
Labor Practice (ULP) charges with the National Labor Relations Board (NLRB)
alleging that the Continental Group condominium management company is illegally
retaliating against employees who express support for a union.
Continental is a subsidiary of FirstService Corporation (Toronto: FSV;
NASDAQ: FSRV).
"Continental
has fired, harassed, and threatened workers who want to form a union," said
Service Employees International Union (SEIU) Local 11 Deputy Director Hiram
Ruiz, "--and that's against the law."
In
June, a subcontractor of Continental at the Waverly condominium cut valet parker
Gildardo Falla's working hours after he started passing out union literature and
cards. Falla had depended on
overtime pay to make ends meet. In
mid-August, Falla spoke out about his decision to file a lawsuit against the
company at a press conference co-hosted by SEIU. Representatives of Continental attended the press conference;
one took photographs of workers there and later wrote down the license plate
numbers of SEIU staff and workers. The
next day, the Continental building manager at the Waverly ordered the valet
subcontractor to transfer Falla to another building. His work conditions there are inferior.
On
August 20, Mercedes Medina, a Continental employee who worked on the front desk
at Sunset Harbour Condominium, was told she would be transferred after it was
discovered that she had spoken to co-workers about signing union support cards.
On August 31, her co-worker Phillip Gonzales was escorted out of the
condominium by Continental and told never to re-enter.
He had recently signed a card expressing support for the union's goals
and was talking to other co-workers about the union. Continental
fired him two days later.
On
August 24, Continental fired Marvin White after the building manager at The
Executive condominium, where White worked, found union support cards that White
had been talking to other workers about. Continental
management illegally interrogated workers at the condo about their union
support, threatened them, and, in another illegal effort to sway them against
the union, promised workers benefits if they refrained from unionizing.
Continental,
in a futile attempt to discredit SEIU, has filed two frivolous charges against
SEIU with the NLRB. It protested
SEIU's use of newspaper advertisements and flyers that drew attention to
concerns about Continental property management services. After the first charge was dismissed by the NLRB
Regional Director, Continental appealed the dismissal to the NLRB’s General
Counsel in Washington, D.C. After
that appeal was denied, Continental filed a new charge against SEIU repeating
the same allegations. The NLRB has
also dismissed the second charge, and once again, Continental has appealed the
dismissal.

Internacional de Empleados de Servicios (SEIU) Local 11 ha presentado cargos por
Prácticas Laborales Injustas (Unfair
Labor Practices—ULPs) ante la Junta Nacional de Relaciones Laborales
(NLRB), alegando que la compañía
de manejo de condominios Continental Group está tomando represalias ilegales en
contra de empleados que expresan su apoyo a la Unión. Continental es
subsidiaria de FirstService Corporation (Toronto: FSV, NASDAQ: FSRV).
“Continental ha despedido,
hostigado y amenazado a trabajadores que quieren formar una Unión,” dijo
Hiram Ruiz, Director Adjunto de la Unión Internacional de Empleados de
Servicios Local 11, “—y eso va contra la ley.”
En junio, un subcontratista de
Continental en el condominio Waverly recortó las horas de trabajo de Gildardo
Falla, un trabajador de valet parking, luego de que éste empezara a circular
literatura y tarjetas sindicales. Falla
dependía del pago de tiempo extra para cubrir sus necesidades. A mediados de agosto, Falla habló sobre su decisión de
presentar una demanda legal contra la compañía en una conferencia de prensa
co-auspiciada por SEIU. Representantes de Continental asistieron a la
conferencia de prensa; uno tomó fotografías de los trabajadores presentes y
luego escribió los números de matrícula vehicular del personal y de SEIU y de
trabajadores. Al día siguiente, el administrador de Continental en el Waverly
ordenó al subcontratista del servicio de valet parking que transfiriera a Falla
a otro edificio. Sus condiciones de
trabajo en este edificio son inferiores.
El 20 de agosto, Mercedes
Molina, una empleada de Continental que trabajaba en la recepción en el
condominio Subset Harbor, fue informada de que sería transferida después de
que se descubriera que había conversado con sus compañeros de trabajo acerca
de firmar tarjetas de apoyo a la Unión. El 31 de agosto, su compañero de
trabajo Phillip Gonzáles fue escoltado por Continental hasta afuera del
edificio y advertido de que no regresara. Él había firmado recientemente una
tarjeta de la Unión expresando su apoyo a sus objetivos y estuvo hablando con
otros compañeros sobre la Unión. Continental lo despidió dos días después.
El 24 de agosto, Continental
despidió a Marvin White luego de que el administrador del condominio The
Executive descubriera tarjetas apoyando la Unión sobre las que White había
hablado con otros compañeros de trabajo. Continental Management interrogó
ilegalmente a trabajadores del condominio sobre su apoyo a la Unión, los amenazó,
y en otro esfuerzo ilegal para persuadirlos en contra de la Unión, les prometió
beneficios si se abstenían de sindicalizarse.
Continental,
en un fútil intento de desacreditar a SEIU, ha presentado dos frívolos cargos
contra la Unión ante la NLRB. Protestó por el uso de anuncios en periódicos y
volantes por parte de SEIU que llamaban la atención sobre las preocupaciones
acerca de los servicios de administración de Continental. Luego de que el
primer cargo fuera desechado por el Director Regional de la NLRB, Continental
apeló la decisión ante el Consejo General de la NLRB en Washington, DC.
Después de que la apelación fuera denegada, Continental presentó un
nuevo cargo contra SEIU repitiendo el mismo alegato.
La NLRB también ha desechado el segundo cargo, y una vez más,
Continental ha apelado dicha decisión.
