STOP FORECLOSURES
IN COMMON INTEREST DEVELOPMENTS
Foreclosures of Homestead Property in Mandated Properties in Common Interest Developments (CID's) are becoming more prevelant in Florida and our nation. 
We refer to CID's as Mandated Properties wherein Homeowners Associations, CONDO Owners associations and the Board of Supervisors in Community Development Districts exist. 
Without considering the Constitution of the United States of America our government has given rights to these mini-governments, leaving homeowners and condo unit owners widely unprotected. 
On many occasions these far reaching rights, given to governing boards in mandated properties, have been abused for the sake of collecting minimum delinquent fees and/or assessments from residents.
Families lost their homes and/or suffered huge financial hardships to avoid being evicted. 
While we don't condone deliquent behavior and the argument could be made that the governing associations and boards need a provision to collect their dues, leaving families homeless is definitely not the solution. 
In recent times some foreclosures have caught the headlines of the media since there was human tragedy involved.

A lot more is going on behind the scenes, mostly unnoticed by the public. In February Miami-Dade County alone recorded 10 (ten) homestead foreclosures, initiated by associations in single family and Condo communities. 

In Texas, the industry has made foreclosures on Homes a big business. People, owing small amounts to associations, are being hit with liens and foreclosures and have to pay big penalties to avoid losing their homes. Please read this story:

             Are our legislators waiting for this kind of disaster to strike in Florida?
Please don't forget that not only delinquent fees and assessments can be used to file for liens and foreclosure but as well fines levvied for all kinds of reasons, which homeowners are only able to defend under the penalty of high court-cost while the association pays the cost with the homeowners money. Do we want to sit idly by and wait until we are targeted by abusive and dictatorial boards and attorneys?
