CONDOMINIUMS (FS 718)

SB 610 -- Sen. Jason Pizzo -- Condominium Associations

Condominium Associations; Revising criminal penalties relating to the acceptance of things or services of value or kickbacks; providing criminal penalties for certain violations relating to official association records; providing criminal penalties for fraudulent voting activities related to association elections, etc


SB 647 -- Rep. Michael Grieco -- Community Association Fire and Life Safety Systems

Community Association Fire and Life Safety Systems; Requires certain associations to post certain signs or symbols on buildings; requires State Fire Marshal to adopt rules governing such signs & symbols; provides for enforcement; revises provisions relating to evidence of association compliance with fire & life safety code; revises provisions related to retrofitting.


HB 721 -- Rep. Sam Killebrew -- Emotional Support Animals

Emotional Support Animals; Provides that individual with disability who has emotional support animal is entitled to access to housing accommodation; prohibits housing accommodation from requiring such individual pay extra compensation; authorizes housing accommodation to request written documentation verifying individual's disability or disability-related need under certain circumstances; specifies individual is liable for certain damage done by emotional support animal; prohibits falsification of written documentation or other misrepresentation; provides penalties.


HB 723 -- Rep. Byron Donalds -- Fire Protection Systems

Fire Protection Systems; Authorizes local authorities to accept inspection reports by specified means; requires State Fire Marshal to adopt rules to implement uniform procedure for submission of inspection reports & provides requirements therefor; requires association to retrofit certain condominiums with fire sprinkler system or Engineered Life Safety System; provides compliance deadlines; provides penalty; authorizes association to elect alternative assessment option while implementing qualifying fire protection improvement.


SB 908 -- Sen. Ed Hooper --  Firesafety Systems

Firesafety Systems; Revising the definition of the term “qualifying improvement” to include improvements to retrofit existing high-rise residential condominiums with certain fire sprinkler systems; requiring that condominium association bylaws provide requirements for the association’s reasonable compliance with the Florida Fire Prevention Code; specifying the date before which a local authority having jurisdiction may not require completion of installation of an engineered life safety system; authorizing condominium associations, under certain circumstances, to elect to be assessed certain taxes and assessments upon the condominium property as a whole, etc.


HB 1075 -- Rep. Anthony Rodriguez -- Community Associations

Community Associations; Revises & provides requirements relating to community associations, including contracts, documents, records, assessments, fines, liens, improvements, online voting, & electronic notice.


SB 1128 -- Sen. Manny Diaz -- Emotional Support Animals

Emotional Support Animals; Providing that an individual with a disability who has an emotional support animal or obtains an emotional support animal is entitled to full and equal access to all housing accommodations; prohibiting a housing accommodation from requiring such individual to pay extra compensation for such animal; specifying that an individual with a disability is liable for certain damage done by her or his emotional support animal, etc.


SB 1152 -- Sen. Jason Pizzo -- Safety Systems

Community Association Safety Systems; Providing that a certificate of compliance from a licensed professional engineer may be accepted as evidence of compliance with certain codes; revising the requirements for retrofitting units, association property, and common elements; prohibiting the local authority having jurisdiction from requiring completion of a retrofitting with certain systems before a specified date, etc.


HB 1259 -- Rep. Javier E. Fernández -- Division of Florida Condominiums, Timeshares, and Mobile Homes

Division of Florida Condominiums, Timeshares, and Mobile Homes; Exempts Division of Florida Condominiums, Timeshares, and Mobile Homes Trust Fund from provision authorizing Legislature, in General Appropriations Act, to transfer unappropriated cash balances from specified trust funds to Budget Stabilization Fund & General Revenue Fund; revises criminal penalties relating to acceptance of things or services of value or kickbacks; provides criminal penalties; revises criminal penalties relating to use of association debit cards; provides criminal penalties for fraudulent voting activities related to association elections.


SB 1362 -- Sen. Joe Gruters -- Community Associations

Community Associations; Prohibiting subrogation rights against a condominium association under certain circumstances; authorizing an association to charge certain costs; providing that certain records are not official association records; authorizing an association to adopt procedures for providing electronic meeting notices; providing requirements for enforcing a lien under certain circumstances, etc.


SB 1732 -- Sen. Gary Farmer -- Community Association Safety Systems

Community Association Safety Systems; Requiring certain condominium or cooperative associations to post certain signs or symbols on buildings; requiring the State Fire Marshal to ensure that such signs or symbols do not diminish the aesthetic value of buildings to which they are affixed and to adopt rules; providing that a certificate of compliance from a licensed professional engineer may be accepted as evidence of compliance with certain codes; providing that the failure to report a membership vote or the recording of a certification to the Division of Corporations of the Department of Business and Professional Regulation does not invalidate an otherwise valid opt-out vote, etc.

HB 155 -- Rep. John Cortes -- Homeowner Association Recalls

Homeowner Association Recalls; Requires voting interests of homeowner association to physically reside in community in order to recall board director.

Quorum Requirements for Homeowners’ Associations; Revising the quorum requirements for meetings of homeowners’ associations, etc.


SB 1442 -- Sen. Victor Torres -- Homeowner Association Recalls

Homeowner Association Recalls; Citing this act as the “Community Recall Act”; requiring the voting interests of a homeowner association to physically reside in the community in order to recall a board director, etc.


 

MOBILE HOME PARK LOT TENANCIES

HB 1023 -- Rep. Michael Grant -- Mobile Home Park Lot Tenancies

Mobile Home Park Lot Tenancies; Requires certain disclosures; authorizes park owner to request certain receipt, enter homeowner's lot to correct certain violations, & charge fee for such action; requires park owner to provide eviction notice to Division of Florida Condominiums, Timeshares, & Mobile Homes; requires division to provide eviction notice to Executive Director of Florida Mobile Home Relocation Corporation; provides notice, election, ballot, & meeting requirements; revises requirements for board nominations, retention of certain documents, & inspection of official records; provides that certain minutes & records are privileged & confidential; revises provisions relating to statutory damages; requires mandatory binding arbitration in certain disputes; provides for award of attorney fees & costs.


SB 1262 -- Sen. Ed Hooper -- Mobile Home Park Lot Tenancies

Providing that certain deficiencies are limited to direct violations of a specified chapter; authorizing a park owner to enter a homeowner’s lot to correct specified violations under certain conditions; requiring a park owner to provide a copy of an eviction notice to the Division of Florida Condominiums, Timeshares, and Mobile Homes within a specified time, etc.
