If your condo building hasn't turned in its Phase One safety inspection report, you could be facing some serious financial penalties in addition to the possible assessments if your building were to have structural issues.

As of Jan. 14, 91 buildings, with approximately 3,200 units, in Palm Beach County covered by the state's new safety-inspection law,have failed to submit even initial reports, setting off alarm bells at a recent county commission meeting.

The law requires residential buildings 30 years or older with three or more stories to undergo initial Phase One or Milestone inspections by Dec. 31. County Building Official Doug Wise has been authorized to begin citing the non-compliant buildings, a process that could result in them being fined unless they comply with the law or at least request an extension. Wise has jurisdiction over the unincorporated areas of the county, which are, for the most part, west of Military Trail. The detailed list does not include the 49 municipalities with condo buildings that are also covered under the new law.

The Legislature passed the safety-inspection law following the deadly condo collapse that occurred in Surfside in June 2021. Nearly a 100 people were killed. The initial inspection requires a state-licensed architect or engineer to examine the structure to determine whether a more detailed Phase Two one is needed. The Phase Two reports must be done within 180 days.

Wise, at the urging of the commission, was asked to prepare a list of buildings not complying with the state law. The list, a copy of which was obtained by The Palm Beach Post, was completed on Jan. 17 following the Jan. 14 county commission meeting.
