Bill Summary By ANALYSIS OF BILL HB 1243 HB 1243 (SUMMARY): Homeowners' Associations
We should support this bill
relating to homeowners' associations. The bill amends s. 468.4334,
F.S. to provide requirements on community association managers and
managing companies authorized by contract to attend in person at
least one member meeting or board meeting of the homeowners'
association annually. The members of the association are to be
provided with the name and contact information for the manager
and/or the person responsible for the community association. The
bill provides, upon request by a member of the association, the
association provide the contract between the community association
manager or community association management firm and the homeowners'
association and include such contract with association's governing
documents. The bill provides that a digital website must be
established and made available to its members, by January 1, 2025,
an association shall post a current digital copy of certain
documents or make such documents available through application that
can be downloaded on a mobile device. In addition, the bill amends
720.30(4)(a), F.S. with requirements that ther certain information
and records that are not accessible on the website or mobile device
application; providing that an association or its agents are not
liable for the disclosure of certain. The bill also provides the
association or its agent will not be not liable for the disclosure
of certain information; requiring an association to adopt certain
rules; requiring an association to provide or make available
subpoenaed records within a certain timeframe, as well as requiring
an association to assist in a law enforcement investigation as
allowed by law. EFFECTIVE JULY 1, 2024 |
