SB 1178 (SUMMARY):
Condominium and Cooperative Associations
We need to support this
bill. The bill contains several provisions to help members and
owners in mandatory associations bill and mimics HB 1021 filed by
Representative Lopez on January 2, 2024.
The bill mandates that association managers and management firms
must return official records of an association within a specified
period following termination of a contract. The bill also requires
that community association managers and management firms disclose
conflicts of interest to the association’s board. The bill specifies
the responsibility delegation relating to financials and financial
reports and for the reporting of investing in such s and In
addition, the bill provides for criminal penalties for any officer,
director, or manager of an association who unlawfully solicits,
offers to accept, including kickbacks.
The bill also amends 718.104, F.S, relating to certain hurricane
protection specifications and that the declarations specify the
entity responsible for the installation, maintenance, repair, or
replacement of such hurricane specifications.
