ANALYSIS OF BILL SB 826/HB 431

SB 826 (SUMMARY):

Fines Levied by Homeowners’ Associations (Senator Victor Torres)
HB 431: Fines Levied by Homeowners’ Associations(Representative Arrington)

Fines Levied by Homeowners’ Associations; Prohibiting fines imposed by homeowners’ associations from exceeding $500 in the aggregate, etc.

 

We cannot support this bill as it stands. It is commendable that this bill amends s. 720.305, F.S.; to prohibit fines imposed by homeowners' associations from exceeding $500 in the aggregate.  However, the following sentence in the bill is the issue -- currently to place a lien on an owner’s parcel is $1,000.00.   This bill would allow a lien to be placed on a parcel as soon as it exceeds $500.00.   This could be a clerical mistake.
