Community Associations; Prohibiting insurance policies from providing specified rights of subrogation under certain circumstances; authorizing a condominium association to extinguish discriminatory restrictions; providing requirements for natural gas fuel stations on property governed by condominium associations; authorizing parties to initiate presuit mediation under certain circumstances; revising the allowable uses of certain escrow funds withdrawn by developers, etc.

Community Association Assessment Notices; Requiring condominium associations to maintain specified affirmative acknowledgments as official records of the association; revising timeframes for foreclosure judgments; requiring condominium associations to deliver certain statements of account to unit owners in a specified manner; requiring condominium associations to give notice to unit owners before changing the method of delivery for the statements of account; requiring cooperative associations to maintain specified affirmative acknowledgments as official records of the association, etc.


SB 996 -- Senator Ileana Garcia -- Community Associations

Community Associations; Specifying requirements for the contents, delivery, and posting of certain association notices; providing that certain associations have the right to seek judicial review, appeal decisions, and represent unit or parcel owners in certain proceedings; providing and revising the parties considered as the defendants in a tax suit; providing unit or parcel owners’ options for defending a tax suit; providing that a condominium association may take certain actions relating to a challenge to ad valorem taxes in its own name or on behalf of unit owners, etc.


HB 649 -- Representative Juan Alfonso Fernandez-Barquin -- Petition for Objection to Assessment

Petition for Objection to Assessment; Provides requirements for condominium, cooperative, & homeowners' associations when filing petition to value adjustment board; requires notice be provided to unit or parcel owners; provides unit or parcel owners have 14 days to elect to not be included in petition; authorizes association to seek judicial review of decision on single joint petition; authorizes such association to defend unit or parcel owners in subsequent proceedings.

Community Association Assessment Notices; Revises provisions relating to condominium, cooperative, & homeowner's associations, including requiring affirmative acknowledgments for certain actions, specified notices to unit & parcel owners, delivery of certain account statements, & timeframes for foreclosure judgments and liens.


HB 1005 -- Representatives Randy Fine and Sam Killebrew -- Investment of Community Association Funds

Investment of Condominium Association Funds; Provides & revises condominium association recordkeeping requirements; provides alternative methods & requirements for investment of association funds; provides how earnings, rather than interest, that accrue on reserve funds may be used; excludes contracts for registered investment advisor services from certain requirements.

Community Associations; Revises & provides requirements relating to community associations, including contracts, documents, records, assessments, fines, liens, improvements, online voting, electronic notice, natural gas fueling stations, alternative dispute resolution, governing documents, emergency powers, & escrow funds.

Homeowners' Association Rental Agreements; Provides applicability for governing documents & amendments relating to rental agreements which are enacted after specified date; provides exception; specifies when change of ownership does or does not occur for certain purposes.
